Before using or subscribing to UrbanVillageScooters.com, please review the following terms and conditions which define your rights, responsibilities and benefits as a user of UrbanVillageScooters.com.

UrbanVillageScooters.com License and Terms and Conditions of Use

UrbanVillageScooters.com is a Web site (the Site) owned and operated by Urban Village Transportation Company, Inc. DBA Urban Village Scooters (hereafter "we", "our" or "us"). "You" or "your" means an adult user of the Site for itself and you as parent or guardian for any minor which you allow to access the Site, for whom you will be held strictly responsible.

Your use of the Site indicates that you are bound by this agreement with us. If you don't agree with any of these terms and conditions, don't use the Site.

We may alter this agreement at our discretion and your continued use after any change indicates your acceptance of that change. If you don't want to be bound by a change, discontinue use of the Site.

UrbanVillageScooters.com contains graphics, information, data, editorial and other content accessible by any Internet user and similar content which is accessible only to registered users (the Content). Whether access is open or restricted, all Content is owned and/or copyrighted by Urban Village Scooters, or third party providers and may be used only in accordance with this limited use license.

UrbanVillageScooters.com is protected by copyright as a collective work and/or compilation, pursuant to U.S. copyright laws, international conventions, and other copyright laws.

Personal Use Only

UrbanVillageScooters.com is made available for your personal, non-commercial use only. The Content is provided to you solely for your own informational purposes. You may not sub-license, resell, republish (including internet posting, electronic mailing, faxing, archiving in a public database, redistributing via a computer network, or in a printed form to third parties), reproduce, retransmit, disseminate, sell, broadcast, commercially exploit, or circulate the Content without the express written consent of Urban Village Scooters.

If you want to make commercial use of the Site or the Content, you must enter into an agreement with Urban Village Scooters to do so in advance. Please contact us for more information.

User Provided Content

Portions of the Site will contain user provided content, to which you may contribute appropriate content. For this content, Urban Village Scooters is a distributor only. By submitting content to UrbanVillageScooters.com, you grant Urban Village Scooters, the corporate host of the Site, a limited license to the content to use, host, distribute that Content and allow hosting and distribution on co-branded Services of that Content.

You should submit only content which belongs to you and will not violate the property or other rights of other people or organizations. Urban Village Scooters is sensitive to the copyright and other intellectual property rights of others. For more concerning copyright issues, view our Copyright Policy.

Urban Village Scooters also reserves the right to remove any user provided content that comes to its attention and that it believes, in its sole discretion, is illegal, obscene, indecent, defamatory, incites racial or ethnic hatred or violates the rights of others.

REGISTRATION AND SECURITY

As part of the registration process, you will select a password and Subscriber name ("Username"). You must provide Urban Village Scooters with accurate, complete, and updated registration information. Failure to do so will breach this Agreement. You understand that you may not

  1. select or use a name of another person with the intent to impersonate that person;
  2. use the Rights of any person other than yourself without authorization; or
  3. use a name that we, in our sole discretion, deem offensive.

As you submit information, you understand that UrbanVillageScooters.com is owned and operated by Urban Village Scooters, registered in New York, USA. The Site is operated in the United States of America and operated to be in compliance with the laws of the United States. Access is governed by these terms and conditions under the laws of the State of New York and the United States.

Registration as a member of the Site results your customer information being stored and processed in the United States, and you, by registering, specifically consent to that storage and processing. You may access that information at any time to confirm its correctness and to keep it current in connection with your membership.

If you are registering for use of this site from outside of the United States of America, you consent to the storage and processing in the United States of the personal data you submit, within the scope of the Privacy Policy of Urban Village Scooters. You may and should review and correct this information regularly.

You shall notify us by regular mail or by e-mail at support@UrbanVillageScooters.com of any known or suspected unauthorized use(s) of your account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password or credit card information.

You will be responsible for maintaining the confidentiality of your password. You will never be required to reveal your password to any representative or agent of Urban Village Scooters, its owners or agents.

You must be 18 years or older to be a member.

You are responsible for all usage or activity on Urban Village Scooters via your password. Distribution of your password to others for access to Urban Village Scooters is expressly prohibited and shall constitute a breech of this Agreement.

Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your account, at our sole discretion, and you may be referred to appropriate law enforcement agencies.

COMMUNICATIONS BETWEEN URBAN VILLAGE SCOOTERS AND YOU

Urban Village Scooters will send electronic mail to you whenever you make a change to your membership, including

  1. becoming a member,
  2. changing your registration information including your password, and
  3. performing a monetary transaction such as renewing, upgrading or extending your membership.

You will also be notified about any changes we have made or are about to make to your account, such as deleting your information because your membership has expired. You cannot opt out of these communications.

Urban Village Scooters will also send electronic mail to you for the purpose of informing you of changes or additions to Urban Village Scooters, or of any Urban Village Scooters related products and services. You may opt out of this notification service by replying to the electronic mail that was sent with the word "unsubscribe" (without the quotes) in the subject line. For further information on our use of subscriber demographic information, see the Privacy Policy on the Site.

TERMINATION

Should you breach this Agreement, Urban Village Scooters will revoke your license to use the Site and suspend your right of access. In such a case, no portion of any payments received will be refunded.

Should Urban Village Scooters decide to suspend the membership service for any reason other than breach, it will refund to you the unused portion of your membership payment, which will be your sole and exclusive remedy upon such a suspension of service.

MODIFICATIONS TO THIS AGREEMENT AND THE SERVICE

Urban Village Scooters has the right, at its sole discretion, to modify this Agreement or the Site at any time. Changes in service will be posted on the Site, or sent via e-mail, or postal mail to you.

If any portion of this Agreement or any change of the Site is unacceptable to you or will cause you to no longer be in compliance with the Agreement, you may cancel your membership by contacting Account Services at Urban Village Scooters.

Continued use of the service now or following posted notices of changes in this Agreement means that you have accepted and are bound by the changes.

MISCELLANEOUS

This Agreement is governed by the law of the State of New York, without regard to its principles on conflicts of laws, and the federal law of the United States of America. Any action to enforce this Agreement shall be brought in the federal or state courts located in Rochester, NY.
